READ THESE TERMS CAREFULLY. They include important disclaimers of liability, limitations of our responsibility for your safety and travel, and a waiver of certain legal rights. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

These Terms of Service ("Terms") govern your use of the Airtura mobile application and related services (together, the "Service"), provided by Awaire Technologies LLC, a California limited liability company ("we," "us," or "our"). "Airtura" is our brand name; the company providing the Service is Awaire Technologies LLC.

What Airtura Is

Airtura is a passenger-facing flight intelligence product. We provide estimates, predictions, and plain-language explanations about flight status, delays, gate assignments, turbulence forecasts, weather conditions, and related flight information. We aggregate this data from third-party sources, generative AI model outputs, and publicly available information.

Airtura is an informational tool only. Airtura is not an airline, not an air traffic control service, not a flight dispatch service, not an operational control authority, and not an official source for any flight information. Airtura is not an official pilot briefing service and must not be used for flight planning by pilots or flight crews.

AI-Generated Content

Significant portions of the content shown in the Service — including flight briefings, "Captain AI" chat replies, delay explanations, post-flight summaries, and other text content — are generated by artificial intelligence (specifically, third-party large language models, including Anthropic's Claude). AI-generated content may be inaccurate, incomplete, biased, or out-of-date. You should not rely on AI-generated content for any safety-critical, travel-critical, or operational decision. Always verify with the airline directly.

Eligibility and Account

You must be at least 13 years old to use the Service. You are responsible for all activity that occurs under your account and for keeping your login credentials secure. You agree to provide accurate information when creating an account, and to promptly notify us of any unauthorized use.

Your Responsibility for Your Own Safety and Travel

By using the Service, you acknowledge and agree to the following:

a. Follow Flight Crew Instructions at All Times

You must always follow the instructions of the flight crew and airline personnel. This includes, without limitation, instructions about seatbelts, electronics, seat position, carry-on items, safety briefings, emergency procedures, and any other crew direction, whether or not those instructions differ from information shown in the Airtura Service.

Airtura is not a substitute for the seatbelt sign, the fasten-seatbelt indicator, or any safety announcement made by the flight crew. If the seatbelt sign is on, you must remain seated with your seatbelt fastened regardless of anything shown in the Service.

b. Turbulence and Ride Quality

Turbulence forecasts in the Service are estimates based on weather models, pilot reports, and AI-generated predictions. They may be wrong, outdated, incomplete, or change without warning. Conditions in the actual atmosphere can differ substantially from any forecast.

Airtura is not liable for any injury, harm, or loss resulting from turbulence, including but not limited to injuries sustained by passengers who were not wearing a seatbelt at the time of an unexpected turbulence event. You agree to keep your seatbelt fastened whenever you are seated, regardless of what Airtura shows, and to follow the flight crew's direction on seatbelt use.

c. Flight Status, Delays, Gate Changes, Cancellations, and Missed Connections

Flight times, delay estimates, gate assignments, terminal information, cancellations, and connection information in the Service are estimates and may be incorrect, delayed, or outdated. You are solely responsible for your travel. Always verify flight status, gate, and timing with the airline directly.

Airtura is not liable for any missed flight, missed connection, delayed arrival, cancellation, rebooking cost, lodging cost, lost baggage, rental car cost, event missed, business opportunity lost, or any other damage or inconvenience resulting from reliance on information in the Service.

d. Operational, Safety, and Professional Use

The Service is intended for passengers. It is not an operational tool. Do not use the Service for flight planning, dispatch decisions, crew briefings, fuel planning, routing, or any aviation operational purpose. Pilots and flight crews must use official FAA, ICAO, airline-approved, or equivalent authoritative sources for all operational and safety-related information. Airtura's output is not a substitute for official NOTAMs, METARs, TAFs, PIREPs, weather briefings, dispatch releases, or any authoritative flight information.

e. Medical and Anxiety-Related Use

Airtura is not a medical device, not therapy, and not a substitute for professional medical or mental-health care. Some of Airtura's features are designed to provide context that some passengers may find calming during anxious flight moments, but Airtura makes no claim of therapeutic benefit and is not intended to diagnose, treat, cure, or prevent any anxiety disorder, phobia, or other medical condition. If you experience significant flight anxiety, please consult a qualified mental-health professional.

Accuracy of Information

We try to provide useful and timely information, but we make no warranty that the information in the Service is accurate, complete, current, reliable, or error-free. Flight data, weather forecasts, turbulence predictions, delay explanations, and AI-generated content (including "Captain AI" features) can contain mistakes. You acknowledge that you use the information at your own risk.

You agree not to:

Intellectual Property

The Service, including all software, text, images, graphics, audio, video, designs, branding (including the "Airtura" mark, the Airtura logo, and other Airtura trademarks), and AI-generated content, is owned by Awaire Technologies LLC or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use, subject to these Terms. All rights not expressly granted are reserved.

"Airtura" and the Airtura logo are trademarks (or pending trademarks) of Awaire Technologies LLC.

Third-Party Services

The Service relies on third parties including Supabase (data storage and authentication), Apple (Sign in with Apple, Push Notification service), Google (Google Sign-In), Anthropic (Claude AI for content generation), and aviation-data providers such as AeroAPI (FlightAware), AVWX, and FAA NASSTATUS. These third-party services have their own terms and privacy policies, and we are not responsible for their acts, omissions, accuracy, or availability.

App Store Terms

If you downloaded the Service from the Apple App Store, you also agree to Apple's standard "Licensed Application End User License Agreement," which applies to your use of the iOS app. These Terms supplement, and do not replace, Apple's terms. Apple is not responsible for the Service or for any claim by you or any third party relating to the Service.

Subscriptions and Purchases

The Service is available at no cost for up to 10 unique flight briefings, counted by unique combinations of flight number and scheduled departure date. Once you have reached this limit, full access to Airtura requires an active paid subscription or a Tura Pass, purchased through the Apple App Store. The free-tier limit persists per account; once reached, you must subscribe or purchase a Tura Pass to view any further briefings, including briefings you have previously viewed. All purchases are processed by Apple under your Apple ID; we do not see or store your payment-method details.

a. Available Plans
  • Monthly subscription. Auto-renewing monthly subscription that grants full access to all Airtura features. New subscribers receive a 1-month free introductory offer, after which the subscription will automatically convert to the then-current monthly price (currently $7.99 USD per month; prices may vary by storefront and may be converted to local currency by Apple).
  • Annual subscription. Auto-renewing yearly subscription that grants full access to all Airtura features for one year, then renews at the then-current annual price (currently $59.99 USD per year).
  • Tura Pass. A one-time, non-renewing purchase that grants 7 days of full access to all Airtura features. Tura Pass does not auto-renew and you may purchase additional passes to extend access. Tura Pass is currently $1.99 USD.
b. Auto-Renewal

Monthly and Annual subscriptions automatically renew at the end of each subscription period unless cancelled at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period at the then-current price for the selected plan. Tura Pass purchases do not auto-renew.

c. Free Trial

New subscribers to the Monthly subscription receive a 1-month free introductory offer. If you do not cancel before the trial ends, your subscription will automatically convert to a paid Monthly subscription and your Apple ID will be charged. The free trial is available only to Apple IDs that have not previously been subscribed to an Airtura subscription. The trial offer may be discontinued or modified at any time.

d. Managing and Cancelling Subscriptions

You can manage or cancel a subscription at any time through your Apple ID settings: Settings → [your name] → Subscriptions on iPhone, or under your Account in the App Store. Cancellations take effect at the end of the current billing period; you retain access through that date but are not charged again. We cannot cancel your subscription on your behalf — cancellation must be made through Apple.

e. Refunds

All refund requests are handled by Apple and are subject to Apple's refund policies. To request a refund, visit reportaproblem.apple.com. We cannot issue refunds directly. The Tura Pass is a one-time consumable purchase and is generally non-refundable once granted.

f. Price Changes

We may change subscription prices from time to time. If a price change affects your existing subscription, Apple will notify you and seek your affirmative consent before charging the new price, in accordance with App Store policies. If you do not consent, your subscription will not renew at the new price.

g. Loss of Access

If your subscription expires, lapses, or is cancelled — or if your Tura Pass period ends — your access to paid features will end. Your account, saved flights, and account history remain on your account and can be restored by starting a new subscription or purchasing a new Tura Pass.

h. Restore Purchases

If you reinstall the app or use a new device signed in to the same Apple ID, you may restore an active subscription or unexpired Tura Pass by tapping Restore Purchases on the paywall.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, THAT ANY DATA WILL BE ACCURATE, OR THAT ANY FORECAST OR ESTIMATE WILL COME TRUE.

Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AWAIRE TECHNOLOGIES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOST OPPORTUNITIES, MISSED FLIGHTS, MISSED CONNECTIONS, LODGING OR REBOOKING EXPENSES, TRAVEL DELAYS, PERSONAL INJURY (INCLUDING INJURY RESULTING FROM TURBULENCE OR FROM NOT WEARING A SEATBELT), EMOTIONAL DISTRESS, OR ANY OTHER DAMAGES ARISING FROM OR RELATED TO YOUR USE OF — OR INABILITY TO USE — THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Awaire Technologies LLC, its officers, directors, employees, contractors, affiliates, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or the rights of a third party; or (d) any content you submit to the Service.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You and Awaire Technologies LLC agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Sonoma County, California, and you consent to personal jurisdiction in those courts.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you through the Service or by email. Your continued use of the Service after an update means you accept the revised Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Awaire Technologies LLC regarding the Service and supersede any prior agreements.
